Scope and acceptance
This website is operated by Terra Industries (Pty) Ltd ("Terra"). These Terms of Use apply to access to and use of the website, including product searches, cross-reference information, quote requests, the Quote List, customer accounts, forms, uploaded files and related content.
Using the website does not by itself create a sale, representation, agency, partnership or guarantee of supply. Any sale remains subject to a written Terra quotation or invoice and the applicable Terms of Sale.
Permitted use
You may use the website for genuine business enquiries, parts identification, availability requests, quote-list building, account requests and communications relating to Terra products or services.
You may not use the website for spam, false enquiries, fraud, social engineering, malicious files, attempted unauthorised access, automated attacks, abusive scraping, bulk data extraction, system overloading, unauthorised copying or any unlawful activity.
Catalogue, cross-reference and technical data
Part numbers, cross-references, applications, descriptions, dimensions, specifications, images and manufacturer data are provided to support identification and enquiry work. Terra aims to use reputable sources and verified data, but technical data can change, contain catalogue variations or depend on the specific machine configuration.
Before purchase or installation, the part must be checked against the original number, machine, model, serial number or VIN where applicable, engine, dimensions, mounting, connections and other relevant details. Imported, rebuilt, modified, re-powered or non-standard machines require additional verification.
Do not install a part solely because it appears in a website search or cross-reference result. Confirm the application and mounting before installation.
Trade marks, manufacturers and third-party sources
OEM and manufacturer names, marks, symbols, part numbers and descriptions are used only for identification, reference and application purposes. Unless expressly stated in writing, Terra does not claim to be affiliated with, sponsored by, endorsed by or authorised by the OEM or manufacturer named.
Content and references obtained from manufacturer catalogues, suppliers and other third-party sources remain subject to the rights of their respective owners. Terra may correct, update, suspend or remove content when errors, product changes or source changes are identified.
Information and files submitted by users
By submitting part numbers, lists, images, documents or other information, you confirm that you have the right to provide them and that the content is not unlawful, malicious, misleading or infringing of third-party rights.
Terra may use submitted material to the extent reasonably necessary to answer the enquiry, verify parts, prepare a quotation, manage an account, provide support and meet legal or security obligations.
Website availability and security
Terra may change, correct, limit, suspend or withdraw website features for maintenance, security, catalogue changes or operational requirements. The website is not guaranteed to be uninterrupted, error-free or compatible with every device.
Users must keep account credentials confidential and promptly notify Terra of any known or suspected unauthorised use of their account.
Limitation of liability and indemnity
To the fullest extent permitted by law, Terra and its directors, employees, agents, contractors, hosting providers, data suppliers and suppliers will not be liable for indirect, incidental, special or consequential loss arising from website unavailability, misuse of the website or reliance on data that has not been properly verified for the specific application.
You indemnify Terra and the persons listed above against third-party claims arising directly from your unlawful use of the website, deliberately false or misleading information, malicious uploads, infringement of third-party rights, or installation/use of a part contrary to instructions or after an obvious incompatibility was ignored.
Nothing in these Terms excludes, limits or waives any right, obligation or liability that cannot lawfully be excluded or limited. No provision is intended to exclude liability for gross negligence where the law prohibits that exclusion.
Governing law, severability and contact
These Terms are governed by the laws of the Republic of South Africa. Any invalid or unenforceable provision will be limited or severed only to the extent necessary, without affecting the remaining provisions.
